DEFINITIONS

In these Terms of Service and Terms of Use:

“Our” and “We”, “Us” and “SA Water” means South Australian Water Corporation a statutory corporation established by section 5(1) of the South Australian Water Corporation Act 1995 (ABN 69 336 525 019) of 250 Victoria Square Adelaide South Australia 5001;

“You”, “Your”, and “Users” refers to the end-user of Our Service and their parent(s) or guardian(s);

“provider” means Geo AR Games Ltd, a registered company with the issued NZBN 9429041991343 which provides "M700050 Software development service" (ANZSIC M700050); and

“Service.”, “App” means Our mobile application game service known as Explore Water.

NOTIFICATIONS

Use by children

If You are under the age of 18, please review these Terms of Service and Terms of Use with Your parent or guardian. You both need to understand how Our Service works and what conditions apply to Your use of Our Service.

If You are the parent or legal guardian of a child under the age of 18 (the “Parent”), You are agreeing to these Terms of Service on behalf of yourself and Your child(ren) who are authorised to use the Service pursuant to these Terms of Service and in accordance with Our Terms of Use.

Non acceptance

If You do not agree to these Terms of Service or Our Terms of Use, please do not use the Service.

TERMS OF SERVICE

Overview

The objective of these Terms of Service is to provide You with the terms of service in respect of the App.

Service Deliver

  • We do not guarantee the availability of the App to You or the safety of any system connected to its network. This includes for example, but is not limited to, virus and hacker activities.

Service Interruption

  • From time to time, We may interrupt the Service for operational reasons as are determined by Us in the exercise of Our sole discretion.
  • You release and agree to defend, indemnify, and hold harmless SA Water and the provider from and against any and all claims, costs, injuries, losses, or damages arising in connection with such interruptions to the Service.
  • Use of the Service is at Your sole risk.

Your responsibilities

* You are solely responsible for the safety of Your hardware, software and data in connection with Your usage of the App.

* You are liable for your actions in connection with Your usage of the App.

* You are solely responsible for Your personal safety while using the App. You agree that Your use of the App is entirely at Your own risk.

* At all times while playing the App, You should be aware of Your surroundings. You should not operate the game near to hazards such as water, roads or uneven ground. You should pay attention to the weather conditions and play responsibly.

* It is Your sole responsibility to ensure the area in which You play the App is safe and appropriate.

* It is Your sole responsibility to ensure you have any insurance policies as You deem reasonably necessary for any injury which could be sustained while using the Service, including but not limited to health, hazard, personal injury, medical, life and liability insurance.

* You must respect the intellectual property of SA Water and the provider and all content featured in the App, being copyrighted material, trademarks and related proprietary information. This includes, but is not limited to text, images, software, photo, video, graphics and sound.

* You are not permitted to:

o intentionally or unintentionally violate any applicable laws, rules or regulations;

o use the App with any content that is unlawful, harmful, abusive, harassing, defamatory, vulgar, obscene, pornographic, libellous, invasive of another’s privacy, inflammatory, hateful, or racially, ethnically or otherwise objectionable and content for which You do not have a legal right to use;

o use the App with any content that infringes any intellectual property of another party;

o use the App for a commercial purpose, for example, without limitation, such as generating revenue, advertising or affiliations;

o interfere with the delivery of the App, including by SA Water, the provider, host, and telecommunication network;

o modify, test, decompile, disassemble, copy, or change the App in anyway

o encourage or enable any other individual to violate any applicable law, rule, or regulation of these Terms of Service; or

o encourage any other User to engage in unsafe play.

No liability

SA Water and the provider are not liable for any damages (direct, indirect, incidental, special, consequential or exemplary) in connection with Your use of the App. To the extent permitted by applicable law, SA Water and the provider exclude all liability related to any property damage, personal injury, or death that may occur during Your use of Our Service.

This applies to the App offered by SA Water and details how We intend to use Your data. We understand that privacy is important to You, and it is important to Us too. Acceptance of Our Terms of Use

When You play Our games, You agree to Our Terms and Conditions - and this includes Our Terms of Use. This means You agree to all the data collection and use which is outlined in Our Terms of Use. We rely on being able to collect some data to improve Our games. If You do not agree to anything in the Terms of Use, You may not be able to play Our games. Our primary goals in collecting information are to provide and improve Our Service, to administer Your use of the Service, and to enable You to enjoy and easily navigate Our Service.

We may collect personal identification information from Users in a variety of ways in connection with activities, services, features or resources We make available through our Service. We will collect personal identification information from Users only if they voluntarily submit such information to Us (e.g. by emailing brand@sawater.com.au).

SA Water may collect and use information to:

* improve customer service;

* improve the App;

* evaluate the educational purposes of the App;

* promote and/or report on the App; and/or

* make improvements to Our products based on feedback from Users.

Sharing your personal information

SA Water operates the App in compliance with the Government of South Australia’s information privacy principles (“IPP”), a copy of which can be obtained on the Department of the Premier and Cabinet website.

SA Water will not disclose Your personal identification information to any other entity except in accordance with the IPP.

We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and Users with other South Australian Government agencies, Australian Government agencies, our business partners, trusted affiliates and advertisers for the purposes outlined above.

Changes to these Terms of Use

SA Water reserves the right to update these Terms of Use at any time. When We do, We will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how We are helping to protect the personal information We collect. You acknowledge and agree that it is Your responsibility to review these Terms of Use periodically and become aware of modifications.

Your acceptance of these Terms of Use

By using our Service, You signify Your acceptance of these Terms of Use. If You do not agree, please do not use Our Service. Your continued use of the Service following the posting of changes to these Terms of Use will be deemed Your acceptance of those changes.
